Welcome to the HiTech Therapy Online store's terms and conditions of use. We are delighted that you wish to use our store. We have established several terms and conditions you agree to bind by using our shop legally. Therefore, they are essential, so please take a few moments to read them. If you disagree with the terms & conditions set out below, please do not use our online store. Please note that you accept these terms and conditions by purchasing on www.hitechtherapyonline.co.za.

  • This website can be accessed at www.hitechtherapyonline.co.za, related Mobi-sites and software applications (the “Website”) and is owned and operated by HiTech Therapy Pty Ltd (“HiTech Therapy”, “we”, “us” and “our”).
  • These Website Terms and Conditions (“Terms and Conditions”) govern the ordering, sale, and delivery of Goods and the use of the Website.
  • These Terms and Conditions are binding and enforceable against every person that accesses or uses this Website or social media pages owned by Hitech Therapy (“you”, “your” or “user”), including without limitation each user who registers as contemplated below (“registered user”).
  • By using the Website and by clicking on the “Register Now” button on the Website, as may be applicable, you acknowledge that you have read and agree to be bound by these Terms and Conditions.
  • The Website enables you to shop online for an extensive range of goods, including Practice Consumables, Hygiene Solutions (PPE), Taping and Strapping, Respiratory Products, Braces and Supports, Orthotics and Foot Supports, Tens and EMS products, Pillows and Supports, Massage Therapy, Resistance Products, Exercise Equipment, Electrotherapy Equipment, Wattbike, Pilates Products and more (“Goods”).
  1. Important Notice:
    • These Terms and Conditions apply to users who are consumers for purposes of the Consumer Protection Act, 68 of 2008 (the “CPA”).
    • These Terms and Conditions contain provisions that appear in similar text and style to this clause and which -
      • may limit the risk or liability of HiTech Therapy; and/or
      • may create risk or liability for the user; and/or
      • may compel the user to indemnify HiTech Therapy; and/or
      • serves as an acknowledgement by the user of a fact.
    • Your attention is drawn to these Terms and Conditions because they are essential and should be carefully noted.
    • If there is any provision in these Terms and Conditions that you do not understand, it is your responsibility to ask HiTech Therapy to explain it to you before you accept the Terms and Conditions or continue using the Website.
    • Nothing in these Terms and Conditions is intended or must be understood to unlawfully restrict, limit or avoid any right or obligation, as the case may be, created for either you or HiTech Therapy in terms of the CPA.
    • HiTech Therapy permits the use of this Website subject to the Terms and Conditions. By using this Website or/and social media pages in any way, you shall be deemed to have accepted all the Terms and Conditions unconditionally. You must not use this Website or/and social media pages if you do not agree to the Terms and Conditions.

  2. Registration & Use of the Website:
    • Only registered users may order goods on the Website.
    • To register as a user, you must provide certain information and personal details to HiTech Therapy. You will need to use your email and password to access the Website to purchase Goods.
    • You agree and warrant that your username and password shall not be disclosed by you to any third party.
    • For security purposes, you agree to enter the correct username and password whenever ordering Goods, failing which you will be denied access.
    • You agree that, once the correct username and password relating to your account have been entered, irrespective of whether the use of the username and password is unauthorized or fraudulent, you will be liable for payment of such order, save where the order is cancelled by you in accordance with these Terms and Conditions.
    • You agree to notify HiTech Therapy immediately upon becoming aware of or reasonably suspecting any unauthorized access to or use of your username and password and to take steps to mitigate any resultant loss or harm.
    • By using the Website, you warrant that you are 18 (eighteen) years of age or older and of total legal capacity. If you are under the age of 18 (eighteen) or if you are not legally permitted to enter into a binding agreement, then you may use the Website and social media pages only with the involvement and supervision of your parent or legal guardian. If your parent or legal guardian supervises you and gives his/her consent, then such person agrees to be bound to these Terms and Conditions and to be liable and responsible for you and all your obligations under these Terms and Conditions.
    • You agree that you will not in any way use any device, software, or other instruments to interfere or attempt to interfere with the proper working of the Website. In addition, you agree that you will not in any way use any robot, spider, other automatic devices, or manual process to monitor, copy, distribute or modify the Website or the information contained herein without the prior written consent from an authorized HiTech Therapy representative (such consent is deemed given for standard search engine technology employed by Internet search websites to direct Internet users to this Website).
    • You may not use the Website to distribute material, which is defamatory, offensive, contains or amounts to hate speech or is otherwise unlawful.
    • You may not in any way display, publish, copy, print, post, or otherwise use the Website and/or the information contained therein without the express prior written consent of an authorized HiTech Therapy representative.

  3. Ratings & Reviews:
    • Any comments uploaded by a user of our website or any authorized experts are their opinions alone and do not necessarily represent the views, opinions, beliefs, or values of HiTech Therapy. By uploading their review/rating, the customer consents to have their name and comment displayed on the website concerning the product that the customer has reviewed/rated and may be published by HiTech Therapy regarding the specified product.
    • Should you use the rating and review platform to display and spread any hate speech, vulgarity, or any other response that is deemed to be harmful at the sole discretion of HiTech Therapy, the offending review/ remark will be removed from our website without any notice to the customer responsible for its creation and may result in the customer’s account being suspended and will further be unable to use our website fully.
    • Furthermore, should HiTech Therapy suffer any harm because of the comments of the user, we reserve the right to prosecute our claim for damages against the customer personally for the harm and/or loss (be it direct, indirect, or consequential) sustained by us as a result of any action or omission of the user.

  4. Privacy Policy:
    • We respect your privacy and will take all reasonable measures to protect it, as more fully detailed in our Privacy Policy, which is incorporated by reference.


  5. Pricing & Stock Availability:
    • All prices displayed on the Website are quoted in South Africa Rand (ZAR) and include VAT at the rate of 15%.
    • These prices are valid and effective only in the Republic of South Africa.
    • Information provided by HiTech Therapy in the form of pricing is subject to change. As we have multiple price inflations along with circumstances such as petrol prices, natural disasters, global pandemics, etc., HiTech Therapy’s prices change over time.
    • HiTech Therapy reserves the right, without prior notice, to discontinue or change pricing on products and services offered on the Website or Mobile App without incurring any liability whatsoever.
    • Though we endeavour to ensure that the prices displayed on the website are accurate, we offer several thousand products, and it is impossible for us to monitor the prices of all individual products manually. While we go to lengths to ensure that the prices we display are accurate, it is possible that erroneous prices may be displayed from time to time. In such cases, we shall not be obliged to sell the product at the incorrect price and will correct erroneous prices as soon as we become aware of them.
    • We source products from all over the world, and the prices we display for products on our website will fluctuate with exchange rates.
    • Displaying a price on the website does not constitute any undertaking by us to maintain that price for any length of time.
    • Additional delivery charges may occur, dependent on the branch location or a specific product.
    • Delivery costs are charged separately on checkout and do not form part of the product price displayed.
    • Items can run out of stock or be discontinued without warning, and we may not be able to fulfil orders for that item.
    • If a product goes out of stock, it will reflect as such on the website or will no longer be visible on the website.
    • We do our best to prevent sales of products that are out of stock, but due to the digital nature of our business, the opportunity exists for an item to go out of stock after an order is placed.
    • HiTech Therapy will take all reasonable measures to source stock where possible to fulfil your order.
    • Where items cannot be delivered, HiTech Therapy will take all reasonable measures to contact the customer based on the information provided at checkout and offer either the option to cancel the order, placing such items on backorder, or reduce the quantities, where applicable.
    • Placing items in your shopping basket without completing the purchase cycle does not constitute an order for such items, and as such, items may be removed from the shopping basket if stock is no longer available or the price thereof might change without notice to you. You cannot hold HiTech Therapy liable if such items are unavailable or are not available at the price when you complete or attempt to complete the purchase cycle at a later stage.
    • HiTech Therapy will make all reasonable efforts to monitor stock levels. However, we cannot guarantee the availability of stock. When items are no longer available after you have placed an order, HiTech Therapy will notify you, and you will be entitled to a refund of any amount already paid by you for such items.
    • COD orders will only be processed once payment reflects; Hitech Therapy cannot be held liable should the product no longer be available once the payment reflects.

  6. Sales & Promotions:
    • HiTech Therapy reserves the right to cancel or change any discounts on products at any given time without prior notice.
    • Discounts will only be valid during specified periods and while stocks last. Once the product is sold out at the sale price, the sale price will no longer be valid.
    • Capital Equipment that is on sale must be paid in cash. No finance deals will be accepted.
    • Discounts cannot be used with any other discount or promotion or applied retrospectively.
    • All prices are as shown on the site. Discounts have already been calculated and reflected in the ‘Was’ price.
    • No exchanges or returns will be accepted on any clearance sale products.

  7. Best Buy Deals Products:
    • HiTech Therapy reserves the right to cancel or change any pricing on products at any given time without prior notice.
    • Pricing will only be valid while stocks last. Once the product is sold out at the sale price, the sale price will no longer be valid.
    • Capital Equipment that is on sale must be paid in cash. No finance deals will be accepted.
    • Discounts cannot be used with any other discount or promotion or applied retrospectively.
    • All prices are as shown on the site. Discounts have already been calculated and reflected in the ‘Was’ price.
    • No exchanges or returns will be accepted on any End-of-Range sale products.
    • Buy 10 get 1 free offers do not apply to any of the End-of-Range products.

  8. Black Friday Promotions
    These Terms and Conditions ("Terms") apply to the Hitech Therapy Black Friday Promotion and govern your participation in the Promotion. By participating, you agree to abide by these Terms. Hitech Therapy reserves the right to modify or cancel the Promotion at any time without prior notice. Please read our Black Friday Terms & Conditions for further details.

  10. Payments:
    • Payment may be made for Goods via the following methods (depending on their availability and/or your eligibility to use such a method) –
      • Direct bank deposit or electronic funds transfer: if you pay via direct bank deposit or electronic funds transfer, payment must be made within 2 (two) days of placing your order. HiTech Therapy will not accept your order if payment has not been received.
      • Cash on instore collection
      • Debit or Credit card instore on collection
      • Payfast 
      • MobiCred - The monthly payment amount displayed is indicative only and based on 12 monthly installments excluding any Mobicred fees.
    • Cash on collection (COD) is offered as a payment option only for orders being collected at any of our offices.
    • When paying by Instant EFT, there will be no waiting period before your payment is received and your order is authorized.
    • There will be a waiting period of 2 days on EFT payments as we will only process the order once the payment is reflected.
    • Mobicred payments: Mobicred is a simple and convenient online credit facility that allows you to shop online and repay your order in monthly installments. Interest is charged at 21% per year. Please note the annual interest rate may change. As a revolving credit facility, Mobicred repayments are calculated as 10% of the account balance plus fees. These fees will be confirmed with you by Mobicred on opening your Mobicred account and could entail the following:
      • A monthly service fee of R42.00 (incl. VAT)
      • Once-off account initiation fee ranging from R119-R610 (incl. VAT), depending on the facility granted.

       

  11. Rental Plans:
    • The monthly rental amount is based on the items taken and the agreement made with HiTech Therapy.
    • The invoice will be done on the 1st (first) day of every month and is payable no later than 7 (seven) days after the invoice date.
    • This rental amount will not fall under the standard 30-day account period.
    • A deposit is payable upfront before delivery.
    • An annual increase of 10% will be loaded on the anniversary of the agreement.
    • Insurance is not included on any rental product.
    • Proof of insurance or letter indicating responsibility to insure is required by the renter before delivery.
    • An updated insurance schedule will be required every 12 (twelve) months.
    • The user agrees to take personal responsibility for the payment of the rental invoice and any damages to the product.
    • The rental period will be specified as per the application form received from the accounts department.
    • A rental period of no less than 6 months is required.
    • The item should be returned at the end of the rental period in perfect working order.
    • Normal wear and tear are acceptable. However, damage to the unit will be on account of the renter.
    • The renter shall have the first option of purchasing the rental item at the end of the rental period.

  12. Rent-to-Own:
    • The rent-to-own option is based on this:
      • Parties agree that the Renter shall take possession of the movable property (“item”) that is owned by the owner and shall have full use of the item for the duration of the agreement.
      • Transfer of ownership of the item will remain with the owner for the duration of this agreement, and the renter shall, upon completion of this agreement, which includes making payment of the full purchase price, become the owner of the Item.
    • As for Social Media:
      • The option “Business behind owning a product- Rent-to-own” is provided on Social Media platforms.
      • The rental amount showcased on Social Media platforms is based on the “Including Tax” amount.
      • The rental amounts are subjected to third-party finance intuition and are based on a 60-month repayment plan.
      • The owners (Hitech Therapy) do not take responsibility for the amount showcased on Social Media platforms. Thus, there can be an unforeseen additional cost, or it can be calculated wrong. Hitech Therapy advised to be in contact with a sales representative and confirm prices before making any commitments.
      • The owner (Hitech Therapy) will not be held by the prices provided on social media platforms due to regular price changes. The price increases can occur due to transportation costs, global pandemics, annual price increases, and many more.

  1. Gift Vouchers & Coupons:
    • HiTech Therapy may, from time to time, make physical or electronic gift vouchers (“Gift Vouchers”) and promotional coupons or discounts (“Coupons”) available for use on the Website towards the purchase of HiTech Therapy Goods. Gift Vouchers and Coupons can only be redeemed while they are valid, and their expiry dates cannot be extended. More specifically:
    • Gift Vouchers:
      • Gift Vouchers that are purchased by registered users are valid for 3 years after the sale. Gift Vouchers that HiTech Therapy gives away for free are valid for the period stated thereon. In each case, if your Voucher has not been used within that period, it will expire.
      • Gift Vouchers cannot be used to buy other Gift Vouchers or Coupons. They do not accrue interest and are not refundable for cash once purchased or otherwise obtained. If your Gift Voucher value is less than the amount required to cover the complete order you wish to place, you may make up the difference by paying via one of our other payment methods.
    • Coupons
      • There are two types of Coupons: A Coupon with a fixed amount of a discount, e.g. R100 off (“Fixed Coupon “), and a Coupon with a percentage discount, e.g. 10% off (“Percentage Coupon “).
      • Coupons are issued at HiTech Therapy’s sole discretion, and we are entitled at any time to correct, cancel, or reject a Coupon for any reason (including without limitation where a Coupon has been distributed unauthorizedly). Users do not have a right to Coupons, and Coupons cannot be earned. Coupons are issued under specific terms and conditions regulating when and how they may be used.
      • As a rule, and unless specified otherwise on the specific Coupon itself:
        • Each Coupon can only be used once.
        • Only one Coupon can be used per order.
        • Coupons and vouchers are only valid for online and app purchases.
      • Only one Coupon can be used on the Website per person per promotion/campaign.
      • Percentage Coupons may only be redeemed on purchases with a total cart value of less than R5,000.
      • Where a Percentage Coupon has been used, and you wish to cancel any items in the order before making payment, the entire order must be canceled. You will be issued a new Percentage Coupon and need to place the order again without the item you wished to cancel.
      • A coupon must be used at check-out – it cannot be used later on existing orders, and the value of the Coupon will be set off against the value of your shopping basket, and the balance remaining, if any, will be payable by you.
      • Coupons cannot be used to buy Gift Vouchers or other Coupons and cannot be exchanged or refunded for cash or credit. HiTech Therapy is not responsible for any harm due to the loss, unauthorized use, or distribution of a Coupon.
      • If for any reason, a Coupon does not reflect on the final amount due from you at check-out, you can contact us at sales@htherapy.co.za to confirm if the Coupon is still valid. If HiTech Therapy confirms that the Coupon is still valid and you have already placed your order, you can choose whether to cancel the order and place it again with the Coupon, or you can use the Coupon on your next order within the limitations of the specific Coupon’s terms and conditions.
      • You may be required to submit the original communication containing the Coupon code and any other information reasonably requested by HiTech Therapy before you are able to use a Coupon.

  1. Delivery of Goods & Service:
    • Deliveries are made Monday to Friday, between 09h00 and 17h00. HiTech Therapy does not deliver over weekends and on any recognized/ statutory South African public holidays.
    • Additional delivery charges may occur, dependent on the branch location or a specific product.
    • Delivery costs are charged separately on checkout and do not form part of the product price displayed.
    • If you spend R1500 or more on your online order, you will qualify for Free Delivery in the city centers where a HiTech therapy branch is located. City centers will be determined by proximity to HiTech Therapy branches throughout South Africa.
    • Free Delivery does not apply to treatment furniture, Pilates Equipment, large exercise equipment, any capital equipment, gym/vinyl mats, any orders over 20Kg or any area that does not fall under the free delivery area zone.
    • Free delivery is only applicable to all ONLINE orders and does not apply to any orders placed via email or telephone.
    • Delivery charges on www.hitechtherapyonline.co.za are according to area positioning.
    • Delivery of any order by HiTech Therapy will only be affected to accessible areas, in the sole discretion of HiTech Therapy, situated within the borders of the Republic of South Africa.
    • Should you wish to amend or change the delivery address of your order, kindly contact us at sales@htherapy.co.za to effect the change. Kindly note that the change of delivery address will only be applicable where the order has not been dispatched from our warehouse. HiTech Therapy will not incur any liability in the successful delivery of the order to the nominated delivery address as per the order confirmation email.
    • Whilst we endeavor to make every effort to ensure that accurate shipping estimates are provided on the website, we make no warranty that the order will be received by you within said time.
    • Unfortunately, items may be delayed for a variety of reasons beyond our control. When we are informed of any delays, that will mean your items will arrive after the shipping estimate period has elapsed, and then we will attempt to notify you as soon as possible. You may cancel a delayed item, without incurring any re-stocking fees, at your discretion, or wait for it to arrive.
    • Due to the influx of purchases taking place on Black Friday and the festive periods, and while we will always endeavor to ensure that your Order(s) are timeously delivered, kindly anticipate unforeseen delays due to the strain placed on our couriers nationally.

 

  1. Returns:
    • If you are, for any reason, dissatisfied with any item purchased online, you may return it to any HiTech Therapy branch within 14 (Fourteen) days* of purchase for a full refund, replacement, or exchange, provided you have the original tax invoice, and it is in its original packaging.
    • Please note that all refunds and returns are subject to Management Approval.
    • Under no circumstances will we accept returned goods where the customer has damaged the goods in negligence; the goods have been disassembled, permanently installed, physically altered, used, or installed contrary to our own or the manufacturer’s instructions, and/or have been subjected to misuse or abuse. Special conditions may be applicable to returns of defective/malfunctioning products:
    • The product must be defective (due to manufacture or design fault) and not damaged due to inappropriate use.
    • When returning a product after the 14 (Fourteen) day standard returns period, a customer must provide full reasons for alleging that the product is defective, and comply with the standard returns policy, including stating how the product was utilized during the period that it was in the customer’s possession.
    • Returning a product after the 14 (Fourteen) day standard returns period will have a 10% handling fee deducted from the refund amount.
    • Please note that should you elect for a refund for any successful returns and/or refunds, it may take between 5 – 10 business days, depending on your bank's processing times, for the funds to reflect in your account.

  2. Warranties:
    • In the event of a defect and to get the benefit of the limited warranty, you must return your products to HiTech Therapy and provide HiTech Therapy with proof of the original date of purchase. Should shipping costs be required to return your products, you will not be responsible for those costs. Evidence of a defect and any claims must be sent to the address set forth at the end of this limited warranty. In the event of a defect, HiTech Therapy will ship replacement products (if applicable) to you.
    • Replacement products are subject to the same limited warranty as the original products. If you obtain replacement products, the warranty term of the replaced products begins from the date of purchase of the original products.
    • Product warranties applies to defects due to faulty workmanship or materials, subject to the limitations described in the warranty. The limited warranty does not cover the following:
      • Normal wear and tear because of washing and intended use.
      • Comfort preference.
      • Physical abuse or damage to the products, including but not limited to, burns, cuts, tears, liquid damage, or stains, provided that the defect is caused by such abuse or damage.
      • Damage caused by commercial use where otherwise stated
    • In the event of a defect, HiTech Therapy’s sole and exclusive liability and your sole remedy under this limited warranty will be, at HiTech Therapy’s discretion.

  3. Feedback & Complaints:
    • We welcome any comments about our service, so we can improve it. Our aim is to deal with any problems quickly and fairly. If you wish to complain, let us know about the unpleasant experience you have had with our company, please e-mail our Customer Care Service department stating clearly that you are making a complaint and use the email address: sales@htherapy.co.za. Alternatively, call us on (+27) 11 704 0002
    • While we will endeavor to respond within 24 (twenty-four) hours to let you know that we are working on the matter, our aim is to respond and resolve the matter within five (5) working days, either resolving the complaint, or with a timescale for resolution.

  4. Social Media Posts:
    • HiTech Therapy has official pages on several social media networks including Instagram, Facebook, Twitter & LinkedIn.
    • We cannot and do not guarantee the accuracy of content posted on our social media pages by us or third parties. We do not, in any way, adopt, endorse, or guarantee the accuracy of content posted by others. We are not legally responsible for content posted by third parties on our social media pages.
    • You agree to comply with the social media guidelines outlined herein regarding any content that you post/share on our pages, and you agree to our right to moderate and delete any content at our sole discretion. You also agree that your activities on our sites will not violate any applicable law, regulation, or terms of any existing agreements you may have with HiTech Therapy.
    • Our social media pages/content may only be used for personal purposes. You may not reproduce, duplicate, copy, sell, resell, or exploit, for any commercial purposes, any portion of our pages, or access to our pages. Any unauthorized use of our pages or misuse of any information posted to social media pages are strictly prohibited. Your use of our social media pages is subject to the following guidelines:
    • You agree that you are responsible for any content that you submit to our social media pages, including comments, photographs, and other media.
    • Posting Content to Our social media pages:
      • Stay relevant – stay on topic with relevant information that others may find useful.
      • DO NOT post advertisements.
      • Be respectful – maintain a friendly environment.
      • Do not post material that is inappropriate or that could reasonably be deemed defamatory, offensive, or obscene.
      • Do not use our social media pages for illegal purposes or to breach any laws.
      • Do not harass, cause distress or inconvenience to, or infringe another person’s rights.
      • Do not try to access administrator areas, features, or functions of our social media pages without authorization.
      • Do not submit anything to our social media pages that will or may violate the rights of a third party, including but not limited to the copyright, trademark, and/or privacy rights.
      • Do not use our social media pages or content in any way not permitted by these terms.
      • You agree that you shall not place false or misleading information on our social media pages.
      • We reserve the right to remove comments and/or posts. We also reserve the right to restrict users who don’t follow these guidelines, have online pages containing offensive material and/content, or for any other reason.
      • By posting any content on any of our social media pages, you grant to HiTech Therapy the irrevocable right to reproduce, distribute, publish, display, edit, modify, create derivative works from and otherwise use such content for any purpose, in any form, and on any media.
    • HiTech Therapy is not responsible for the privacy or security practices of the social media networks we utilize. Please review their (Social Media Network) policies.
    • The content provided on our social media pages is owned or licensed by HiTech Therapy unless otherwise indicated. Unless expressly noted otherwise, everything on our social media pages is protected by intellectual property rights held by HiTech Therapy or other parties that have allowed HiTech Therapy to use their materials.
    • HiTech Therapy may revise these terms of use for its social media pages at any time without notice. These terms of use may be updated at any time and/or each time a social media network updates its terms of use. By using these social media pages, you are agreeing to be bound by the then-current version of these terms of use. Any modifications to these terms shall be effective as of the date posted. We encourage you to periodically review these terms.
    • Information provided by HiTech Therapy in the form of pricing is subject to change. As we have multiple price inflations along with circumstances for example petrol prices, natural disasters, global pandemics, etc., HiTech Therapy’s prices do change over time. HiTech therapy cannot be held by previous prices and the correct information surrounding pricing will be shown on the online website at the current version.
    • The option “Business behind owning a product- Rent-to-own” is provided on Social Media platforms.
    • The rental amount showcased on Social Media platforms is based on the “Including Tax” amount.

  5. Competitions:
    • Competitions are open only to residents of the Republic of South Africa only and all entries must be made in the English language.
    • Anyone working for HiTech Therapy, or any family members or associates are prohibited from entering any of the competitions hosted by HiTech Therapy, and further any associated Company and/or any professional and/or commercial entities are similarly prohibited from entering.
    • The closing date for any competition is as stated on the entry form or related material disclosing the same.
    • No late entries will be allowed or accepted as being eligible for any competition.
